§ (1) (1) Dieses Bundesgesetz gilt - abgesehen von § 5 - nur für Fernsehveranstalter, auf die das ORF-Gesetz, BGBl. Nr. 379/1984, oder das Privatfernsehgesetz, BGBl. I Nr. 84/2001, Anwendung findet. [EU]

This Act shall, with the exception of § 5, apply only to television broadcasters covered by the Austrian Broadcasting Act (Österreichischer Rundfunkgesetz - ORF-Gesetz), published in the Federal Law Gazette (BGBl.) No 379/1984, or the Private Television Act (Privatfernsehgesetz), BGBl. I No 84/2001.

22 Except as stated in paragraph 22A, a contract that will be settled by the entity (receiving or) delivering a fixed number of its own equity instruments in exchange for a fixed amount of cash or another financial asset is an equity instrument.

23 With the exception of the circumstances described in paragraphs 16A and 16B or paragraphs 16C and 16D, a contract that contains an obligation for an entity to purchase its own equity instruments for cash or another financial asset gives rise to a financial liability for the present value of the redemption amount (for example, for the present value of the forward repurchase price, option exercise price or other redemption amount).

.5 Unbeschadet des Absatzes .1 dieser Regel 10 kann die Verwaltung des Flaggenstaates gestatten, dass vom Einbau eines Doppelbodens in jedem Schiffsteil abgesehen wird, der durch einen Faktor von höchstens 0,50 unterteilt wird, wenn sie sich davon überzeugt hat, dass der Einbau eines Doppelbodens in dem betreffenden Schiffsteil nicht mit der Bauart und dem ordnungsgemäßen Betrieb des Schiffes vereinbar sein würde. .5 Notwithstanding paragraph .1 of this Regulation 10, the Administration of the flag State may permit a double bottom to be dispensed with in any part of the ship which is subdivided by a factor not exceeding 0,5, if satisfied that the fitting of a double bottom in that part would not be compatible with the design and proper working of the ship.
