The Court of First Instance concludes from the above that the contested Decision is tainted by defective reasoning such that it is unable to ascertain the merits of the Commission's appraisal whereby, assuming that the disputed measures constitute an advantage, this advantage is not selective because it is justified by the nature and scheme of the system.

Consequently, the Court finds that, as a result of the determination of the absence of reasons in point 90 above, as well as the determination in the previous point, the contested Decision does not contain sufficient grounds in its assessment as to why the disputed measures do not constitute State aid within the meaning of Article 107(1) of the TFEU.
