[EU]	The Commission does not therefore dispute the principles, assessment basis and methods of calculation applied by the French Republic to establish a rate of contribution in full discharge of liabilities adjusted to equalise the levels of wage-based social security contributions and tax payments between France Télécom and the other undertakings of the telecommunications sector subject to the ordinary social security arrangements, as indicated in the updated comments of the French Republic and described and detailed in Annexes III and V to these comments.

[EU]	To a large extent, and even though the French authorities did not recognise it explicitly, the allocation of the exceptional flat-rate contribution in question in the La Poste decision was therefore the result of negotiations between the Commission and the Member State with a view to ensuring the payment of a contribution in full discharge of liabilities ensuring a competitively fair rate.

EUR, der von France Télécom bereits 1997 gezahlt wurde, zu berücksichtigen, um ihn dem unzureichenden, für France Télécom geltenden Beitragssatz mit befreiender Wirkung gegenüberzustellen. [EU]	Likewise, contrary to the claims of the French Republic and France Télécom, it is not justified to take into consideration the amount of the exceptional flat-rate contribution of EUR 5,7 billion already paid by France Télécom in 1997 to compare it with the insufficiency of the rate of the contribution in full discharge of liabilities applied to France Télécom.
	Festzustellen ist, dass die jährlichen Abgaben mit befreiender Wirkung, die France Télécom seit der Reform von 1996 entrichtet hat, es nicht ermöglichen, einen Satz zur Sicherung gleicher Wettbewerbsbedingungen zu erreichen, wie in der Entscheidung über die Eröffnung des Verfahrens betont wurde. [EU]	The fact remains that the annual levies in full discharge of liabilities paid by France Télécom since the 1996 reform do not permit a competitively fair rate to be achieved, as emphasised in the decision to initiate the procedure.
	Frankreich muss bei der Berechnung des Satzes des Beitrags mit befreiender Wirkung auch dafür sorgen, dass France Télécom und die anderen Unternehmen des Telekommunikationssektors, für die die allgemeinen Vorschriften für Sozialleistungen gelten, tatsächlich gleich hohe gehaltsbezogene Sozialabgaben und Steuern zahlen, und dabei auch die nicht gemeinsamen Risiken der privatrechtlich Beschäftigten und Beamten von France Télécom einbeziehen. [EU]	The French Republic should also, when calculating the rate of the contribution in full discharge of liabilities, equalise in fact the levels of wage-based social security contributions and tax payments between France Télécom and the other undertakings of the telecommunications sector subject to the ordinary social security arrangements, also taking account of the risks not common to the ordinary employees and the civil servants employed by France Télécom.
