Abschließend ist festzustellen, dass die Kommission Finnland und dem Beihilfeempfänger gegenüber zu keinem Zeitpunkt eindeutig bestätigt hat, dass es sich bei den streitigen Maßnahmen nicht um staatliche Beihilfen oder anwendbare Beihilfen handelt, was ein berechtigtes Vertrauen diesbezüglich begründen könnte. [EU] Finally, the Commission has never given either Finland or the aid beneficiary any precise assurance that the measures at issue would not be State aid or would be compatible aid, which might create expectation to that effect [39].
