Am 5. März 2008 wies Österreich auf ein deutsches Gerichtsurteil hin, das eine BaFin-Entscheidung bestätigte, mit der der Verkauf von Anteilen einer deutschen Bank an eine ukrainische Unternehmensgruppe untersagt worden war. [EU]

On 5 March 2008 Austria referred to a German court judgment confirming a BaFin decision prohibiting the sale of shares in a German bank to a Ukrainian group.

The Commission considers a fortiori that the decision taken by Belgium following the Court's judgment definitively confirming the incompatibility of the scheme with the common market to renew upon request the authorisations for all the coordination centres until the end of 2010 cannot form part of the existing measure or even be covered by some legitimate expectation or other raised by the Commission.
