76 % der Arbeitnehmer zwischen 55 und 59 Jahren hatten ein niedriges Ausbildungs- und Qualifikationsniveau, weshalb sie im Fall einer Kündigung nicht von anderen Sektoren übernommen werden konnten. 76 % of the workers aged between 55 and 59 years had low training and skills, which prevented their transfer to other sectors if they were laid off. Angesichts der vorstehenden Ausführungen und gemäß ihrer Entscheidungspraxis vertritt die Kommission die Auffassung, dass die Durchführung zusätzlicher Sozialmaßnahmen zugunsten der entlassenen Arbeitnehmer aus öffentlichen Mitteln, ohne den Arbeitgeber von seinen normalen Kosten zu entlasten, unter die Sozialpolitik der Mitgliedstaaten fällt und keine direkte Beihilfe im Sinne von Artikel 87 Absatz 1 EG-Vertrag darstellt. In light of the foregoing and in accordance with its previous decisions, the Commission considers the implementation by means of public funds of additional social measures in favour of persons laid off, without the measures in question relieving the employer of the normal charges it has to bear, to be a matter for the Member States within the scope of their social policy, and does not constitute direct aid within the meaning of Article 87(1) EC.
