In its judgment on the Deggendorf case, the Court of First Instance of the European Communities held that, 'when the Commission considers the compatibility of a State aid with the common market, it must take all the relevant factors into account, including, where relevant, the circumstances already considered in a prior decision and the obligations which that previous decision may have imposed on a Member State.

In der vorliegenden Entscheidung muss die Kommission diese Verpflichtung gemäß der vorstehend genannten Deggendorf-Rechtsprechung zur Voraussetzung für die Vereinbarkeit der angemeldeten Beihilfe mit dem Gemeinsamen Markt machen. [EU]

In this Decision, the Commission is required, on the basis of the findings in Deggendorf, to transform this commitment into a condition precedent to the compatibility of the notified aid.

In this connection, the Commission Notice Towards an effective implementation of Commission decisions ordering Member States to recover unlawful and incompatible State aid (OJ C 272, 15.11.2007, p. 4) states that 'the Commission has [...] started to apply Deggendorf case law in a more systematic manner.

In the decision to open the formal investigation of 10 September 2008, the Commission expressed doubts concerning the following aspects: the justification of aid, the incentive effect/necessity of aid, the cumulation of regional and training aid, and compliance with the so-called 'Deggendorf principle' (all discussed below).

CUMULATION AND THE DEGGENDORF JURISPRUDENCE

Mit ihrem dritten zusätzlichen Argument bedauert ACEA, dass die Kommission die Deggendorf-Rechtsprechung nicht kohärent anwende. [EU]

The third additional argument that ACEA puts forward is the claim that the Commission is not coherent in its application of the jurisprudence Deggendorf.

According to the judgment of the Court of Justice in Deggendorf [24], when the Commission examines the compatibility of aid, it must take all the relevant factors into account, including any cumulative effect of that aid and other aid which has not been repaid.
