Derzeit werden in den ostdeutschen Bundesländern drei Anlagen gebaut, die die Bioethanol-Produktion, vorzugsweise aus Roggen und Weizen aufnehmen sollen. [G]

Notwithstanding paragraph 1, sales on the Community market may be organised on the basis of specific invitations to tender for the processing of cereals into bioethanol and the use of this bioethanol to produce biofuels in the Community, provided that supply to traditional food markets is not threatened. In such cases, the minimum selling price shall be at least equal to the price recorded for an equivalent quality and for a representative quantity on the market of products used to produce biofuels, account being taken of transport costs.

On 25 November 2011, the European Commission ('the Commission') announced, by a notice published in the Official Journal of the European Union [2], the initiation of an anti-subsidy proceeding ('AS proceeding' or 'the proceeding') with regard to imports into the Union of bioethanol originating in the United States of America ('USA' or 'the country concerned').

Based on official sources, market and publicly available information [8], all types of bioethanol and bioethanol contained in blends, namely mixtures of bioethanol with mineral gasoline, which are produced and sold in the USA and exported are considered to be bioethanol fuels and are part of a legislative package concerning energy efficiency and renewable energy and alternative fuels in the USA.

In view of the particular circumstances in the present case, i.e. the fact that the scheme focuses for example on cellulosic biofuels, and the lack of commercial cellulosic bioethanol production, it is considered that during the IP this scheme did not confer any benefit on commercial producers of bioethanol in the USA and consequently did not have any impact on exports of bioethanol to the EU during the IP.

As the economic circuits used require the transport of the bioethanol, provision should be made for the possibility of storing it with intermediaries by mixing it with identical products not obtained under the invitation to tender concerned.

In the case of alcohol awarded for a new industrial use and alcohol awarded under tendering procedures for use as bio-ethanol in the fuel sector in the Community which must be rectified prior to the final use intended, the alcohol removed shall be deemed to have been used entirely for the purpose specified where at least 90 % of the total quantities of alcohol removed under an invitation to tender is used for that purpose.
