[EU]	In accordance with the analysis developed in recitals 157 to 161 of decision C 56/2007, to which it refers mutatis mutandis, the Commission notes firstly that the Law of 1980 [87] and its implementing provisions [88] designate the State as the authority responsible for covering the debts of publicly owned establishments, and confer important prerogatives on the State: the mandatory payment order and the creation of sufficient resources.

	Im Fall von Unternehmen wie La Poste, die von unabhängigen Ratingagenturen bewertet werden, wies die Kommission unter Ziffer 4.1.2.a des Beschlusses in der Sache C 56/2007 nach, dass das Unternehmen aufgrund seines Status als öffentliche Einrichtung günstigere Finanzierungsbedingungen als bei einer Beurteilung anhand seiner eigenen Leistungen erhalten konnte. [EU]	In the case of undertakings such as La Poste, which are the subject of a financial rating by independent agencies, the Commission showed, in point 4.1.2(a) of decision C 56/2007, that the guarantee conferred by the status of publicly owned establishment allowed the beneficiary establishment to obtain more favourable borrowing terms than those that it would have obtained on its own merits.
	Im Gegensatz zu ihren Schlussfolgerungen in der Sache La Poste im Beschluss in der Sache C 56/2007 stellt die Kommission allerdings fest, dass im vorliegenden Fall die Eigenmittel, die das IFP mobilisieren könnte, relativ hoch sind, da gemäß den Erläuterungen der französischen Behörden in Erwägungsgrund 44 die flüssigen Mittel und Anlagen (150,3 Mio. EUR) Ende 2007 nahezu fünf Mal so hoch waren wie die Summe der Kredite und Finanzverbindlichkeiten (25,2 Mio. EUR). [EU]	However, contrary to the conclusion it drew in respect of La Poste in decision C 56/2007, the Commission observes that in this case the resources of its own that IFP would be able to mobilise are relatively high, since, as the French authorities have explained (see recital 44), available funds and investments at the end of 2007 (EUR 150,3 million) represented approximately five times the amount of borrowings and financial liabilities (EUR 25,2 million).
	Im Übrigen nimmt die Kommission aus den bereits in den Erwägungsgründen 223 bis 226 des Beschlusses in der Sache C 56/2007 dargelegten Gründen, auf welche sie entsprechend verweist, den Vorschlag Frankreichs zur Kenntnis, in alle eine Forderung beinhaltenden Verträge des IFP eine Klausel aufzunehmen, mit der die verschuldensunabhängige Haftung des Staates allein aufgrund der Zahlungsunfähigkeit des IFP begrenzt würde. [EU]	Furthermore, for the reasons already set out in recitals 223 to 226 of decision C 56/2007, to which it refers mutatis mutandis, the Commission takes note of the French proposal to include a clause in all IFP contracts involving claims so as to limit any risk of triggering the State's strict liability based on IFP's insolvency alone.
	Im Übrigen weist die Kommission das Vorbringen der französischen Behörden zurück, die Stellungnahme sei auf das IFP nicht übertragbar, weil sie aus der Zeit vor dem LOLF stamme und im Widerspruch zur späteren Rechtsprechung des Conseil d'Etat stehe, da die Kommission in Erwägungsgrund 104 sowie im Beschluss in der Sache C 56/2007 dargelegt hat, dass das Vorliegen einer impliziten Staatsgarantie für das IFP durch das LOLF nicht ausgeschlossen wird. [EU]	The Commission rejects the arguments put forward by the French authorities to the effect that the opinion is not applicable because it predates the Organic Law governing the Finance Act and is contrary to the subsequent case-law of the Council of State: in recital 104 above, and in decision C 56/2007, the Commission concluded that the Organic Law governing the Finance Act did not stand in the way of an implied guarantee given by the State to IFP.

[EU]	In the present case, the Commission considers that the arguments set out in decision C 56/2007 can essentially be transposed to the EPIC status of the publicly owned establishment IFP, and that IFP also enjoys a special legal position with regard to the payment of its creditors and its continuation in business in the event of insolvency.

[EU]	In decision C 56/2007, the Commission concluded [70] that the special factors intrinsically linked to the legal form of La Poste as a publicly owned establishment [71], and in particular the existence of a guarantee ensuring the payment of individual claims and the continued existence of La Poste or its obligations or both, implied that the State performed the role of guarantor of last resort in respect of the economic activities of the publicly owned establishment.
	Per Schreiben vom 10. September 2007 teilten die Kommissionsdienststellen Belgien mit, dass die Beihilferegelung in das Register der nicht angemeldeten Beihilfen unter der Nummer NN 56/2007 eingetragen wurde, da sich herausgestellt hatte, dass ein Teil der Mittel bereits ausgezahlt worden war.
