Abschließend ist die Überwachungsbehörde hinsichtlich der unter I.2.1 d oben beschriebenen Maßnahme der Ansicht, dass durch eine allgemein gehaltene Bürgschaft über eine bestimmte Schuldenhöhe nicht sichergestellt werden kann, dass eine bestimmte Aufgabe von allgemeinem wirtschaftlichem Interesse erfüllt wird, und dass diese Maßnahme daher nicht nach Artikel 59 Absatz 2 EWR-Abkommen zu bewerten ist. By way of derogation from paragraph 1, the competent authority may agree or require that an undertaking demonstrate its financial standing by means of a certificate such as a bank guarantee or an insurance, including a professional liability insurance from one or more banks or other financial institutions, including insurance companies, providing a joint and several guarantee for the undertaking in respect of the amounts specified in the first subparagraph of paragraph 1.
