Juni 2008 angefallenen Zinsen stellt die Kommission fest, dass die vorgeschlagene Beihilfe das so genannte Deggendorf-Prinzip erfüllt. [EU]

In light of the documentation submitted by Romania to show that the incompatible privatisation aid of EUR 27 million and accruing interest were reimbursed by Ford on 27 June 2008, the Commission concludes that the proposed aid satisfies the so-called Deggendorf principle.

Both projects were declared compatible, but it was decided to open the proceedings pursuant to Article 6 of Council Regulation (EC) No 659/1999 of 22 March 1999, based on the Deggendorf jurisprudence [3]. The present case thus concerns only the energy saving project.

This aid had been declared unlawful and incompatible by Commission Decision 2004/343/EC of 16 December 2003 on the aid scheme implemented by France for the takeover of firms in difficulty, and the Commission expressed doubts about the compatibility of the notified aid under the 'Deggendorf' case law.

According to the Deggendorf jurisprudence, the compatibility of new aid could depend on the existence of any previous unlawful aid that has not been repaid, since the cumulative effect of the aid could distort competition in the common market to a significant extent.

The Deggendorf principle has been integrated into the Chapter on aid for rescuing and restructuring firms in difficulty of the Authority's State Aid Guidelines [76] and into Decision No 195/04/COL as well as into Block Exemption Regulations which have been incorporated into the EEA Agreement [77].

However, in its judgement of 15 May 1997, the Court of Justice has stated that 'when the Commission examines the compatibility of a State aid with the common market it must take all the relevant factors into account, including, where appropriate, the circumstances already considered in a prior decision and the obligations which that decision may have imposed on a Member State'.

Deshalb ist Rumänien der Ansicht, dass die beantragte Beihilfe mit dem so genannten Deggendorf-Prinzip vereinbar ist. [EU]

As a consequence, Romania considers that the notified aid is in compliance with the so-called Deggendorf principle.

The Deggendorf jurisprudence applies whenever a beneficiary of an aid has not paid back what the Commission decided, irrespective of the fact that the case is individual or concerns a scheme [17].

Nevertheless, the Commission expressed doubts and decided to open the investigation procedure, as it considered that the principles and criteria endorsed in the Court jurisprudence ('Deggendorf') are applicable.
