Angesichts der derzeitigen außergewöhnlichen Umstände würden die genannten Ziele ohne die Beihilfemaßnahme in dem jeweiligen Umfang und der jeweiligen Form nicht erreicht werden. [EU]

Since the aid scheme, as a whole and in all parts, except for relocation of farm buildings in the agricultural sector, does not qualify for any of the exceptions provided for in the Treaty, the Commission concludes that the aid scheme is incompatible with the common market, except for relocation of farm buildings in the agricultural sector, for which, on the basis of the analysis made above, aid granted:

Angesichts der vorstehenden Erwägungen ist die Behörde der Ansicht, dass die Freistellung des HFF von der Zahlung einer staatlichen Bürgschaftsprämie aufgrund der besonderen Art der in einer staatlichen Garantie enthaltenen Beihilfeelemente keine von der impliziten und unbeschränkten staatlichen Bürgschaft des isländischen Staates getrennte staatliche Beihilfemaßnahme im Sinne von Artikel 61 Absatz 1 des EWR-Abkommens darstellt. Bearing in mind the above, the Authority considers that, due to the special nature of aid elements contained in a State aid measure in the form of a State guarantee, the relief of HFF from payment of a State guarantee premium does not constitute a separate State aid measure from the implicit and unlimited State guarantee provided by the Icelandic State, within the meaning of Article 61(1) of the EEA Agreement.

In order to define whether the measure forms an integral part of the aid measure, several elements should be taken into account: the revenue from the charge must be reserved exclusively for funding the aid and must necessarily be allocated to the financing of the aid [52], the charge must be hypothecated to the aid measure under the relevant national rules [53], and the amount of the charge should have a direct impact on the amount of State aid [54].

Based on the above findings on overcapacity in the malt market, possible effects on trade between Member States of the aid measure in question and the lack of a clearly distinctive separate market for premium malt, the Commission considers the aid not to comply with point 4.2.5 of the guidelines, which provides that no aid may be granted for investments in products for which normal market outlets cannot be found.

Under the proposed aid measure, the preselected beneficiaries (small and medium-sized enterprises operating in the Autonomous Province of Trento) would receive State contributions for costs arising from investment in railway wagons and rolling stock, while other enterprises, whether Italian or from other EU Member States, that are active in this field would not receive such contributions.

In the light of these arguments, the Commission comes to the conclusion that the aid measure does not respect the principle of non-discrimination as the measure results in a de facto discrimination against foreign road hauliers and, for this reason already, must be considered as incompatibile with the common market.

On the basis of these elements, the Commission concludes that the method of financing the aid, in this case the compulsory voluntary levies, forms an integral part of the aid measure, and should therefore be taken into account by the Commission when examining the aid.

On the basis of the foregoing, the Commission concludes that the measure complies with the relevant provisions of the Environmental Aid Guidelines, the Agricultural Aid Guidelines and the relevant provisions of the Energy Tax Directive.

In any event, the Commission cannot allow such hypothetical considerations to impede the restoration, as far as possible, of the competitive situation that existed before the implementation of an illegal aid measure.

Aus allen Erwägungen ergibt sich, dass die Beihilfemaßnahme gemäß Artikel 1 des Regionalgesetzes Nr. 27/2000 mit dem Gemeinsamen Markt unvereinbar ist und dass diese nicht gewährt werden darf. [EU]

In the light of the points set out above, the aid measure provided for in Article 1 of Regional Law No 27/2000 is incompatible with the common market and may not be implemented.
