On those grounds and on the basis of Article 14(1) of Regulation (EC) No 659/1999, since the principle of protection of legitimate expectations is a 'general principle of Community law', recovery of the aid from which Shetland Seafish Ltd has benefited will not be required.

Angesichts der Würdigung der vorstehenden Ausführungen ist die Kommission der Auffassung, dass die im Rahmen der Kreditregelung für Lachszuchtunternehmen gewährte Beihilfe sowie die der D Watt (Shetland) Ltd. 2002 im Rahmen der Kreditregelung für Fisch verarbeitende Unternehmen gewährte Beihilfe keine staatliche Beihilfe im Sinne des Artikels 87 Absatz 1 EG-Vertrag darstellt. In view of the foregoing, the Commission finds that the aid granted under the Scheme for Salmon Farming Loan Assistance as well as the aid granted in 2002 to D Watt (Shetland) Ltd under the Loan Scheme for Fish Processing does not constitute State aid within the meaning of Article 87(1) of the Treaty.

In the light of the assessment made in Section IV, the Commission finds that the United Kingdom has, in breach of Article 88(3) of the EC Treaty, unlawfully granted aid to Shetland Fish Products Limited under the Fish factory improvement scheme.

In the light of the assessment made in Section IV, the Commission finds that the United Kingdom has, in breach of Article 88(3) of the EC Treaty, unlawfully granted aid to Shetland Seafish Ltd by acquiring shares in the company under circumstances and conditions that would not have been acceptable to a normal private market-economy investor.

Angesichts dieser Sachverhalte ist die Kommission der Auffassung, dass die von der SLAP 1999 und 2000 vorgenommenen Investitionen in die Shetland Seafish Ltd keine üblichen kommerziellen Investitionen waren, die auch ein normaler privater Investor getätigt hätte. [EU]

With regard to the foregoing, the Commission considers that the investments in Shetland Seafish Ltd made in 1999 and 2000 by SLAP are not normal commercial investments which could have been decided upon by any normal private investor.

In addition, given the circumstances and the specific features of the Shetland community, Shetland Seafish Ltd must have been aware of the loan scheme for the purchasing of fishing quotas and in particular the explanatory leaflet referred to in paragraph 68 of Decision 2003/612/EC, stating that the grants and loans from the Charitable Trust would be regarded as private contributions.

However, since the Commission has also consistently acted in such a way as to suggest that the fund is a private fund, the Commission considers that, given the circumstances of the case and the decision of the Commission referred to above, both SLAP and Shetland Seafish Ltd, the beneficiary of the aid, could assume that only private funds are involved and that, therefore, the State aid rules of the Treaty did not apply.
