	Am 13. April 2005 wurde mit der Verordnung (EG) Nr. 552/2005 der Kommission (nachstehend "vorläufige Verordnung" genannt) ein vorläufiger Antidumpingzoll auf die Einfuhren bestimmter Magnesia-Steine mit Ursprung in der Volksrepublik China (nachstehend "VR China" genannt) in die Gemeinschaft eingeführt. [EU]	On 13 April 2005, the Commission imposed, by Regulation (EC) No 552/2005 [2] (the provisional Regulation), a provisional anti-dumping duty on imports into the Community of certain magnesia bricks originating in the People's Republic of China (PRC).
	Am 13. Juli 2004 veröffentlichte die Kommission im Amtsblatt der Europäischen Union eine Bekanntmachung über die Einleitung eines Antidumpingverfahrens betreffend die Einfuhren bestimmter Magnesia-Steine mit Ursprung in der Volksrepublik China (nachstehend "VR China" genannt) in die Gemeinschaft. [EU]	On 13 July 2004 the Commission announced by a notice published in the Official Journal of the European Union [2] the initiation of an anti-dumping proceeding with regard to imports into the Community of certain magnesia bricks originating in the People's Republic of China (PRC).
	Am 8. Oktober 2010 leitete die Kommission nach Anhörung des Beratenden Ausschusses im Wege einer im Amtsblatt der Europäischen Union veröffentlichten Bekanntmachung ("Einleitungsbekanntmachung") ein Auslaufüberprüfungsverfahren betreffend die Einfuhren bestimmter Magnesia-Steine mit Ursprung in der VR China in die Union ein. [EU]	On 8 October 2010 the Commission, after consultation of the Advisory Committee, announced, by a notice published in the Official Journal of the European Union ('the notice of initiation') [6], the initiation of an expiry review proceeding concerning imports into the Union of certain magnesia bricks originating in the PRC.
	Angesichts der Einstellung der Auslaufüberprüfung und in Anbetracht der Tatsache, dass TRL die betroffene Ware in der Zeit vom Inkrafttreten der Verordnung (EU) Nr. 850/2010, bis zum Auslaufen der Antidumpingmaßnahmen (13. Oktober 2010) nicht einführte, sollte die Überprüfung für einen neuen Ausführer betreffend die Einfuhren bestimmter Magnesia-Steine mit Ursprung in der VR China in die Union ebenfalls eingestellt werden. [EU]	In view of the termination of the expiry review and given the fact that TRL did not import the product concerned between the date of the entry into force of Regulation (EU) No 850/2010 and the date of expiry of the anti-dumping measures (13 October 2010), it is considered that the 'new exporter' review concerning imports into the Union of certain magnesia bricks originating in the PRC should therefore also be terminated.
	Angesichts des Vorstehenden ist es unwahrscheinlich, dass die Antidumpingmaßnahmen auf dem Gemeinschaftsmarkt das Angebot verknappen oder den Wettbewerb beeinträchtigen würden, zumal die chinesischen Magnesia-Steine weiterhin ihren Marktanteil halten dürften. [EU]	Considering the above, it is unlikely that anti-dumping measures would lead to a shortage of supply or to a non-competitive situation on the Community market, in particular, as Chinese magnesia bricks are still likely to retain the current market share.
	Auch die betroffene Ware und die vom Antragsteller hergestellten und auf dem Gemeinschaftsmarkt verkauften Magnesia-Steine waren den Untersuchungsergebnissen zufolge gleichartig. [EU]	Likewise, no differences were found between the product concerned and the magnesia bricks produced by the complainant and sold on the Community market.
	Aufgrund der exakten unter Erwägungsgrund 26 erläuterten Umstände sollten die endgültigen Antidumpingzölle ausnahmsweise erstattet bzw. erlassen werden, die nach der Verordnung (EG) Nr. 1659/2005 des Rates über die Einfuhren bestimmter Magnesia-Steine mit Ursprung in der Volksrepublik China, welche ab dem 14. Oktober 2010 (dem Datum des Auslaufens der Antidumpingmaßnahmen) in den zollrechtlich freien Verkehr übergeführt wurden, entrichtet oder buchmäßig erfasst wurden. [EU]	Due to the precise circumstances explained in recital 26 above, the definitive anti-dumping duties paid or entered in the accounts pursuant to Regulation (EC) No 1659/2005 on imports of certain magnesia bricks originating in the People's Republic of China released for free circulation as from 14 October 2010, the date of expiry of the anti-dumping measures, should exceptionally be repaid or remitted.

	Bei der betroffenen Ware handelt es sich um chemisch gebundene, ungebrannte Magnesia-Steine mit einem MgO-Gehalt von mindestens 80 %, auch mit Magnesit, die derzeit unter die KN-Codes ex68159100 und ex68159900 fallen. [EU]	In the absence of any other comments regarding the definition of the product concerned and the like product, it is therefore concluded that the product concerned is defined as chemically bonded, unfired magnesia bricks, whose magnesia component contains at least 80 % MgO, whether or not containing magnesite, originating in the PRC, declared within CN codes ex68159100, ex68159910 and ex68159990.
	Das Verfahren wurde auf einen Antrag hin eingeleitet, der am 7. Juni 2004 von der "European Refractories Producers Federation" (P.R.E., nachstehend "Antragsteller" genannt) im Namen von Herstellern gestellt wurde, auf die ein erheblicher Teil, in diesem Fall mehr als 50 %, der gesamten Produktion bestimmter Magnesia-Steine in der Gemeinschaft entfällt. [EU]	The proceeding was initiated as a result of a complaint lodged 7 June 2004 by the European Refractories Producers Federation (P.R.E.) (the complainant) on behalf of producers representing a major proportion, in this case more than 50 %, of the total Community production of certain magnesia bricks.
