In line with the case law of the European Court of Justice [55], and in view of giving effect to Article 1(3) in Part I of Protocol 3 to the Surveillance and Court Agreement, national courts should order recovery of the financial advantage resulting from premature implementation of the aid (hereinafter referred to as "illegality interest").
