Commission Directive 91/321/EEC of 14 May 1991 on infant formulae and follow-on formulae (OJ L 175, 4.7.1991, p. 35), as amended by:

Absatz 1 gilt nur in ausdrücklichen Ausnahmefällen für Säuglingsanfangsnahrung, Folgenahrung, Getreidebeikost und andere Beikost sowie diätetische Lebensmittel für besondere medizinische Zwecke für Säuglinge und Kleinkinder gemäß der Richtlinie 89/398/EWG. [EU]

Paragraph 1 shall not apply to infant formulae, follow-on formulae, processed cereal-based foods and baby foods and dietary foods for special medical purposes intended for infants and young children as referred to in Directive 89/398/EEC, except where specifically provided for.

On 23 September 2009 the company Biothera Incorporated made a request to the competent authority of Ireland to place yeast beta-glucans on the market as a novel food ingredient for use in a variety of foods, including beverages, for the general population as well as in food supplements and in foods for particular nutritional uses with the exception of infant formulae and follow-on formulae.

Auf der Grundlage der vorgelegten Daten kam die Behörde in ihren Stellungnahmen, die am 13. Februar bzw. am 23. März 2009 bei der Kommission eingingen, zu dem Schluss, dass zwischen der Aufnahme von Säuglingsanfangsnahrung und Folgenahrung mit zugesetzter DHA und der Entwicklung der Sehkraft bei Säuglingen, die bis zur Entwöhnung gestillt wurden oder von Geburt an bis zur Entwöhnung mit DHA angereicherte Säuglingsnahrung mit einem DHA-Gehalt von 0,3 % in Bezug auf die Fettsäuren insgesamt erhielten, ein kausaler Zusammenhang hergestellt wurde. On the basis of the data submitted, the Authority concluded in its opinions received by the Commission on 13 February and 23 March 2009 respectively that a cause and effect relationship had been established between the intake of infant and follow-on formulae supplemented with DHA and the visual development in infants either breastfed until weaning or having received a DHA-enriched formula containing 0,3 % of fatty acids as DHA from birth until weaning.
