Fourthly, the Commission rejects the argument of the French authorities that, if a State guarantee does exist in favour of EPICs, any establishment of a new EPIC (including by change of legal form) would necessitate measures to preserve the rights of creditors arising before the change, and that conversely (modus tollens), since no such mechanism has ever been set up [79], no guarantee exists in favour of the publicly owned establishment IFP:
