For the reasons outlined above, the Authority finds that a private operator would not have entered into such a long option agreement, on similar conditions as the municipality of Asker without requiring remuneration for the option and the favourable conditions as such.

For the above-mentioned reasons, the Authority finds that the price agreed upon in the option agreement did not corresponded to the market price for such an agreement, which should reflect the property value at the time of the agreement combined with the value of the option and the special arrangements granted to the buyer.
