Auf dem Treffen am 8. Juli 2008 hat die Gesellschaft ISD Polska erläutert, dass die Adaptationsarbeiten in dem kleinen Trockendock der Gdingener Werft ihrer Meinung nach keine Stilllegung der Hellingen vor dem zweiten Halbjahr 2009 erlauben. [EU]

At the meeting on 8 July 2008 ISD Polska stated that it assumed that the work to fit out the small dry dock at Gdynia would not allow the slipways to be closed before the second half of 2009.

Dennoch ist die Kommission noch immer nicht von der Behauptung der italienischen Behörden überzeugt, dass die ATSM-Werft innerhalb kürzester Zeit von einem Trockendock für Schiffsreparaturen in eine echte Schiffsbauwerft umgerüstet werden kann. [EU]

Der Gutachter der Kommission ist der Auffassung, dass Italien keine überzeugenden Auskünfte hinsichtlich der Organisation und der für das Trockendock der ATSM-Werft vorgesehenen Ressourcen erteilt hat. Aus diesem Grund hat der Gutachter erhebliche Zweifel daran, ob eine Werft, die bisher hauptsächlich für Reparaturaufträge ausgestattet war und über keine Erfahrung im Bau von Kreuzfahrtschiffen verfügt, in eine perfekt organisierte Werft umfunktioniert werden kann, die innerhalb kurzer Fristen ein Kreuzfahrtschiff abliefern kann. According to the expert consulted by the Commission, Italy has not come forward with convincing information as regards the organisation and resources to be set up at ATSM's dry dock and he strongly doubts that a yard, mainly used for ship repair and inexperienced in cruise vessels, could be turned into a fully organised yard able to deliver a cruise vessel within a tight deadline.

Die Aufgabe einiger Objekte, wie die vorgeschlagene Stilllegung von Trockendock SD I in der Gdingener Werft, kann durch die Steigerung der Produktionskapazitäten des zweiten Docks vollständig ausgeglichen werden. [EU]

It should therefore be noted that the closure of some facilities, such as the proposed closure of the SD I dry dock at Gdynia Shipyard, can be entirely offset by the increase in the capacity of the remaining dock.

Die Kommission beruft sich auf den mit Polen geschlossenen Vorvertrag über die Stilllegung von Trockendock SD I. The Commission recalls the preliminary agreement with Poland on the closure of SD I dock. However, in the light of further developments following this agreement and the above conclusions on the first two conditions of the Guidelines, there is no need to assess whether the countervailing measures proposed by Poland were sufficient.

Im Schreiben vom 28. Februar 2007 verpflichtete sich Polen zur Schließung von Dock SD I in der Gdingener Werft nach Bearbeitung aller vertraglich vereinbarten Aufträge und dem Abschluss der erforderlichen Investitionen im Trockendock SD II, d. h. ab Januar 2010. [EU]

By letter of 28 February 2007 Poland undertook to close the SD I dock in Gdynia Shipyard after outstanding orders had been processed and the necessary investments in the SD II dry dock had been completed, i.e. as of January 2010.

Italien vertritt die Auffassung, dass eines der fünf Schiffe durchaus in Ancona und auf der ATSM-Werft hätte gebaut werden können, obwohl das Trockendock in Ancona kürzer als das geplante Schiff ist. Dazu wollte man ein Spezialverfahren anwenden, das man bereits einmal bei einem Kreuzfahrtschiff angewandt hat, nämlich die Zusammenfügung zweier Rumpfteile des Schiffs (die "Jumboisierung"). [EU]

Italy claims that it would have been possible to build one of the five ships at Ancona and ATSM even though the dry dock at Ancona is shorter than the ship in question, thanks to a special procedure used once before for a cruise ship, i.e. combining two ship sections (jumboisation).

Italien weist außerdem darauf hin, dass der Schiffsreparaturbetrieb im Trockendock der ATSM-Werft zurzeit in enger Abstimmung mit Fincantieri erfolgt. [EU]

It also stresses that in its ship-repair activities ATSM is currently working in synergy with Fincantieri.

Mit Schreiben vom 31. Juli 2007 informierten die Kommissionsdienststellen Polen dann, dass sie bereit sind, die Schließung von Trockendock SD I als ausreichende Ausgleichsmaßnahme einleitend anzuerkennen, unter der Bedingung, dass die Schließung des Objekts die Verschrottung auf eine solche Weise bedeutet, dass die Montage und der Stapellauf von Schiffen unumkehrbar unmöglich gemacht sind und unter der Bedingung, dass die Schließung des Docks zum 1. September 2009 oder früher erfolgt, falls das Schiff 8185/04 - das letzte Schiff aus dem Auftragsbuch der Werft nach dem Stand vom 8. März 2007 - früher vom Stapel gelassen wird. [EU]

Eventually the Commission informed Poland by letter of 31 July 2007 that it was prepared, on a preliminary basis, to consider the closure of dry dock SD I as a sufficient countervailing measure on condition that the closure entailed scrapping the facility in such a way as to irreversibly disable ship assembly and launching activities and that closure was implemented as of 1 September 2009, or earlier if vessel 8185/04, the last one on the yard's order book as at 8 March 2007, were launched prior to that date.

Zieht man in Betracht, dass die Werft dann nur über ein Objekt zum Stapellauf von Schiffen - das Trockendock SD II - verfügen würde und die Werft auf der Grundlage der eingehenden und glaubwürdigen Analyse der Rentabilitätsschwelle nachgewiesen hat, dass jede Verringerung der Produktionskapazitäten im Trockendock SD II, außer der Stilllegung von Trockendock SD I, die langfristige Rentabilität der Werft gefährden würde, entschieden die Kommissionsdienststellen vorläufig, dass die von Polen vorgeschlagene Stilllegung von Trockendock SD I eine ausreichende Ausgleichsmaßnahme darstellt. Taking into account that the yard would be left with only one launching facility, the SD II dry dock, and that it had demonstrated by means of a detailed, credible break-even analysis that any reduction in the capacity of the SD II dry dock, in addition to the closure of the SD I dock, would endanger the yard's long-term viability, the Commission concluded on a preliminary basis that the closure of the SD I dock proposed by Poland would be a sufficient countervailing measure.
