Als Antwort auf das Argument der französischen Behörden, wonach die Beihilfe vorlag, weil sie vor Ablauf der Umsetzungsfrist der zweiten Bankenrichtlinie am 1. Januar 1993 beschlossen wurde, macht die Kommission geltend, dass durch diese Richtlinie der Binnenmarkt im Bereich der Kreditinstitute unter dem Aspekt der Niederlassungsfreiheit und des freien Dienstleistungsverkehrs vollzogen werden sollte. Even when assuming that an exemption from the directive entailed that the HFF would be granted an advantage, the measure would not be imputable to the Icelandic State, but to the EEA Joint Committee, and would accordingly not constitute State aid [32].Third, even if HFF had been covered by the Banking Directive, any exemption would not have entailed a transfer of State resources, as the State would not forego any revenue in such a situation.
