[EU]	It follows a fortiori from that case-law that the Commission is under no obligation to assess the compatibility of the pension subsidy under Article 106(2) TFEU in the present case, where the Member State and the beneficiary explicitly reject a possible compatibility assessment under that provision.

	Da die Kommission zu keinem Zeitpunkt eine Entscheidung bzw. einen Beschluss erlassen hat, demzufolge die Pensionssubvention keine Beihilfe bzw. eine mit dem Binnenmarkt vereinbare Beihilfe darstellte, gelangt sie zu dem Ergebnis, dass die Pensionssubvention eine neue Beihilfemaßnahme darstellt. [EU]	In conclusion, since the Commission has never taken a decision declaring that the pension subsidy was not an aid or was a compatible aid, the Commission concludes that the pension subsidy constitutes a new aid measure.
	Da die Pensionsreform von 1995 an der Haftung des Bundes gegenüber den Beamten nichts geändert habe, entstehe der Deutschen Post durch die Pensionssubvention kein finanzieller Vorteil.
