Am 31. Juli 2001 hat das Handelsgericht Marseille ein gerichtliches Vergleichsverfahren gegen die CMdR eröffnet. [EU]

On 31 July 2001, the commercial court of Marseille opened bankruptcy proceedings in respect of CMdR.

Aufgrund des Beschlusses ihrer ehemaligen Aktionäre und insbesondere der Swissair, ihre Investitionsstrategie nicht länger fortzusetzen, und in Ermangelung neuer Kapitalgeber eröffnete das Handelsgericht Créteil am 19. Juni 2001 ein gerichtliches Sanierungsverfahren gegen die Unternehmen Air Liberté AOM (ehemals AOM Minerve), Air Liberté und fünf ihrer Tochtergesellschaften. [EU]

Following the decision by their former shareholders, and particularly Swissair, to no longer continue their investment strategy, and confronted with a lack of new investors, the companies Air Liberté AOM (formerly AOM Minerve), Air Liberté and five subsidiary companies were subject to compulsory administration proceedings by the Créteil Commercial Court on 19 June 2001.

Consequently, faced with serious financial difficulties, Air Lib filed for bankruptcy with the Créteil Commercial Court on 13 February 2003 and the Court ruled on 17 February that the company should be wound up; this ruling was upheld on appeal on 4 April.

In respect of the interim operating losses, the Commission considers that the estimate is cautious in the light of the legislation, in particular Articles L.622-10 of the Commerce Code and 119-2 of Decree No 85-1388 of 27 December 1985 pursuant to which SNCM may be obliged by the Commercial Court having jurisdiction to continue its operations for a term of two months, renewable at the request of the prosecuting authority on account of its public service obligations.
