	In Zusammenhang mit der Befreiung von den Eintragungsgebühren und -abgaben vertritt Portugal den Standpunkt, dass - da der Rechtsakt einer Umwandlung von einem staatlichen Unternehmen in eine Aktiengesellschaft nicht der notariellen Beurkundung bedarf - keinerlei Grundlage für die Rückforderung dieser Abgaben und Gebühren besteht. [EU]	As regards the exemption from registration charges, the Portuguese authorities commented that, since it was not necessary to issue a public deed formalising the act of conversion of the public undertaking into a public limited company, no basis existed for the collection of the respective taxes and emoluments.

[EU]	Conclusion: It should be concluded that the exemption of RTP from the requirement of a notarial deed (including notarial costs), as well as the exemption from the requirement for publication and the respective publication costs according to Article 11(1) of Law No 21/92, do not constitute State aid within the meaning of Article 107(1) TFEU.
	Schlussfolgerung: In Anbetracht dieser Fakten stellt die Befreiung von dem Erfordernis der notariellen Beurkundung der Umwandlung von RTP (und von den dabei anfallenden Kosten) keine staatliche Beihilfe im Sinne von Artikel 107 Absatz 1 AEUV dar.
