Ab dem 1. Januar 2007 dürfen die Mitgliedstaaten aus Gründen, die sich auf den Regelungsgegenstand der jeweiligen Richtlinie beziehen, weder die EG-Typgenehmigung von zwei- und dreirädrigen Kraftfahrzeugen versagen noch die Zulassung, den Verkauf oder die Inbetriebnahme solcher Fahrzeuge untersagen, wenn sie den Bestimmungen der Richtlinien 93/14/EWG, 93/34/EWG, 95/1/EG und 97/24/EG in der Fassung dieser Richtlinie entsprechen. With effect from 1 January 2007, with respect to two- or three- wheel vehicles which comply with the provisions laid down in Directives 93/14/EEC, 93/34/EC, 95/1/EC, and 97/24/EC respectively, as amended by this Directive, Member States shall not, on grounds relating to the subject matter of the Directive concerned, refuse to grant EC type-approval or prohibit the registration, sale or entry into service of such a vehicle.

With effect from 1 July 2007, Member States shall refuse, on grounds relating to the subject matter of the Directive concerned, to grant EC type-approval to any new type of two- or three-wheel motor vehicle which does not comply with the provisions laid down in Directives 93/14/EEC, 93/34/EC, 95/1/EC and 97/24/EC respectively, as amended by this Directive.

Abfälle, die gemäß den Absätzen 1 und 2 nicht mehr als Abfälle angesehen werden, sind auch für die Zwecke der Verwertungs- und Recyclingziele der Richtlinien 94/62/EG, 2000/53/EG, 2002/96/EG und 2006/66/EG sowie anderer einschlägiger Gemeinschaftsvorschriften nicht mehr als Abfälle anzusehen, soweit die auf Recycling oder Verwertung bezogenen Anforderungen dieser Rechtsvorschriften erfüllt sind. Waste which ceases to be waste in accordance with paragraphs 1 and 2, shall also cease to be waste for the purpose of the recovery and recycling targets set out in Directives 94/62/EC, 2000/53/EC, 2002/96/EC and 2006/66/EC and other relevant Community legislation when the recycling or recovery requirements of that legislation are satisfied.

Except in cases falling within Articles 7(9), 20, or 21, Member States shall ensure that, where national regulatory authorities intend to take measures in accordance with this Directive or the Specific Directives, or where they intend to provide for restrictions in accordance with Article 9(3) and 9(4), which have a significant impact on the relevant market, they give interested parties the opportunity to comment on the draft measure within a reasonable period.

By derogation from paragraph 1, plastic materials and articles intended to be brought into contact with food intended for infants and young children, as defined by Commission Directives 2006/141/EC [15] and 2006/125/EC [16], shall not transfer their constituents to food simulants in quantities exceeding 60 milligrams of total of constituents released per kg of food simulant.
