Dies steht im Einklang mit Randnummer 106 der Schlussanträge von Generalanwalt Mengozzi in der Rechtssache Essent und mit dem Urteil des Gerichtshofs in der Rechtssache Steinike. [EU] This is in line with point 106 of the conclusions of Advocate-General Mengozzi in Essent, and with the judgment of the Court of Justice in Steinike [36].

Dies stellte auch Generalanwalt Jacobs in seinen Schlussanträgen zum anschließenden Urteil des Gerichtshofes fest: "... die Wirkung der 0,35%-Schwelle (wurde) vom Gerichtshof im Urteil Adria-Wien [nicht] untersucht".
