Ad-hoc-Beihilfen, die alle Bedingungen dieser Verordnung erfüllen, sind mit dem Gemeinsamen Markt im Sinne von Artikel 87 Absatz 3 Buchstabe c EG-Vertrag vereinbar und von der Anmeldepflicht gemäß Artikel 88 Absatz 3 EG-Vertrag freigestellt, sofern die Kurzbeschreibung gemäß Artikel 25 Absatz 1 vorgelegt wurde und in der Beihilfe ausdrücklich unter Angabe des Titels sowie der Fundstelle im Amtsblatt der Europäischen Union auf diese Verordnung verwiesen wird. Ad-hoc aid, fulfilling all the conditions of this Regulation, shall be compatible with the common market within the meaning of Article 87(3)(c) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the summary information provided for in Article 25(1) has been submitted and that the aid contains an express reference to this Regulation, by citing its title and publication reference in the Official Journal of the European Union.

Ad hoc aid fulfilling all the conditions of Chapter I of this Regulation, as well as the relevant provisions of Chapter II of this Regulation, shall be compatible with the common market within the meaning of Article 87(3) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the aid contains an express reference to the relevant provisions of this Regulation, by citing the relevant provisions, the title of this Regulation and its publication reference in the Official Journal of the European Union.

Ad hoc aid which is only used to supplement aid granted on the basis of transparent regional investment aid schemes and which does not exceed 50 % of the total aid to be granted for the investment, shall be compatible with the common market within the meaning of Article 87(3) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the ad hoc aid awarded directly fulfils all the conditions of this Regulation.

Artikel 6 Absatz 2 derselben Verordnung besagt, dass zwischen dem 1. Januar 2005 und sechs Monate nach Inkrafttreten der vorliegenden Verordnung gewährte De-minimis-Einzelbeihilfen, die die Voraussetzungen der Verordnung (EG) Nr. 1860/2004 erfüllen, die bis zum Inkrafttreten der vorliegenden Verordnung für den Sektor der Erzeugung landwirtschaftlicher Erzeugnisse gilt, als Maßnahmen angesehen werden, die nicht alle Tatbestandsmerkmale von Artikel 87 Absatz 1 EG-Vertrag erfüllen und daher nicht der Anmeldepflicht nach Artikel 88 Absatz 3 EG-Vertrag unterliegen.. Article 6(2) of the same Regulation states that 'any de minimis aid granted between 1 January 2005 and six months after entry into force of this Regulation, which fulfils the conditions of Regulation (EC) No 1860/2004 applicable to the sector of agricultural production until the date of entry into force of this Regulation, shall be deemed not to meet all the criteria of Article 87(1) of the Treaty and shall therefore be exempt from the notification requirement of Article 88(3) of the Treaty'.
