Artikel 14 Absatz 1 in Teil II des Protokolls 3 bestätigt die ständige Rechtsprechung des EuGH und verpflichtet die Überwachungsbehörde, die Rückforderung rechtswidriger und mit dem Funktionieren des EWR-Abkommens unvereinbarer Beihilfen anzuordnen, sofern dies nicht gegen einen allgemeinen Rechtsgrundsatz der EWR verstößt. Article 14(1) in Part II of Protocol 3 confirms the constant case law of the ECJ [10] and establishes an obligation on the Authority to order recovery of unlawful and incompatible aid unless this would be contrary to a general principle of law.

The aid to the banks flowing from this guarantee was therefore existing, and that applied also where Anstaltslast did not merely follow from a general principle of law, but later had been introduced explicitly in written legal provisions (cf. According to European Union case law, the Commission is required to take exceptional circumstances into consideration that might justify its waiving the order for recovery of the aid unlawfully granted when the said recovery runs counter to a general principle of EU law.
