Am 22. März 2005 veröffentlichte die Kommission im Amtsblatt der Europäischen Union eine Bekanntmachung über die Einleitung einer Untersuchung (nachstehend "Bekanntmachung über die Verfahrenseinleitung" genannt), in der geprüft werden sollte, inwieweit gemäß Artikel 24 Absatz 3 der Grundverordnung Sonderbestimmungen festgelegt werden müssen um sicherzustellen, dass der Ausgleichszoll auf die Einfuhren von DRAMs mit Ursprung in der Republik Korea ordnungsgemäß erhoben wird. On 22 March 2005, by a notice (the notice) published in the Official Journal of the European Union [3], the Commission announced the opening of an investigation with a view to determining to what extent special provisions may need to be adopted in accordance with Article 24(3) of the basic Regulation in order to ensure that the countervailing duty is correctly levied on imports of DRAMs originating in the Republic of Korea.

On 31 August 2004, the Arbitrator determined that the level of nullification or impairment caused every year to the Community was equal to 72 % of the amount of CDSOA disbursements relating to anti-dumping or countervailing duties paid on imports from the Community for the most recent year for which data are available at that time, as published by the United States' authorities.

On 6 January 2004, the Commission received a request, pursuant to Article 13(3) of the basic anti-dumping Regulation and to Article 23(2) of the basic anti-subsidy Regulation, from DuPont Teijin Films, Mitsubishi Polyester Film GmbH and Nuroll SpA to investigate the alleged circumvention of the anti-dumping and countervailing measures imposed on imports of PET film originating in India.

On 8 March 2006, two Council Regulations concerning imports of PET film originating in India were published: Regulation (EC) No 367/2006 [6] which followed an expiry review investigation and maintained the definitive countervailing duty ('the expiry review anti-subsidy Regulation'); and Regulation (EC) No 366/2006 [7] ('the amending anti-dumping Regulation') which followed a partial interim review investigation and amended the definitive anti-dumping duty on such imports.

In view of the definitive conclusions reached with regard to subsidisation, injury, causation and Union interest, and in accordance with Article 15(1) of the basic Regulation, it is considered that a definitive countervailing duty should be imposed on imports of the product concerned originating in Iran, Pakistan and the United Arab Emirates at the level of the lowest of the subsidisation and injury elimination level found, in accordance with the lesser duty rule.

In the light of the foregoing conclusions reached with regard to subsidisation, injury, causation and Union interests, and in accordance with Article 15(1) of the basic Regulation, it is considered that a definitive countervailing duty should be imposed on imports of the product concerned originating in the PRC at the level of the lower of the subsidy and the injury margins in line with the lesser duty rule.

Angesichts der Höhe der festgestellten Subventionsspannen und des Umfangs der Schädigung des Wirtschaftszweigs der Gemeinschaft wird es für notwendig erachtet, die Sicherheitsleistungen für den mit der vorläufigen Verordnung eingeführten vorläufigen Ausgleichszoll bis zur Höhe des endgültigen Zolls endgültig zu vereinnahmen. [EU]

In view of the magnitude of the subsidy margins found and in the light of the level of the injury caused to the Community industry, it is considered necessary that the amounts secured by way of the provisional countervailing duty, imposed by the provisional Regulation should be definitively collected to the extent of the amount of the definitive duties imposed.

Angesichts der Höhe der für die ausführenden Hersteller in Indien festgestellten Subventionsspannen und des Ausmaßes der Schädigung des Wirtschaftszweigs der Gemeinschaft wird es als notwendig erachtet, die Sicherheitsleistungen für den mit der vorläufigen Verordnung eingeführten vorläufigen Ausgleichszoll endgültig bis zur Höhe der endgültigen Zölle zu vereinnahmen. In view of the magnitude of the subsidy margins found for the exporting producers in India and given the level of the injury caused to the Community industry, it is considered necessary that the amounts secured by way of provisional countervailing duty imposed by the provisional Regulation should be definitively collected to the extent of the amount of definitive duties imposed.

Angesichts der Schlussfolgerungen im Hinblick auf die Höhe der Subventionierung von Garware und der Tatsache, dass die derzeitigen Maßnahmen zum Ausgleich der festgestellten anfechtbaren Subventionen nicht ausreichen, sollte der Ausgleichszoll auf Einfuhren der betroffenen Ware der Firma Garware geändert werden, damit den jetzt festgestellten Subventionsbeträgen Rechnung getragen wird. In view of the conclusions reached with regard to the level of subsidisation of Garware and the insufficiency of the current measures to counteract the countervailable subsidies found, the countervailing duty on Garware imports of the product concerned should be amended in order to reflect the new subsidisation levels found.
