Januar 2011 stellte die Regierung der Bundesrepublik Deutschland bei der Kommission einen Antrag nach Artikel 114 Absatz 4 AEUV auf Genehmigung der Beibehaltung der deutschen Rechtsvorschriften für die Freisetzung der fünf Elemente Blei, Arsen, Quecksilber, Barium und Antimon sowie von Nitrosaminen und nitrosierbaren Stoffen aus Spielzeugmaterialien nach Anwendungsbeginn von Anhang II Teil III der Richtlinie 2009/48/EG des Europäischen Parlaments und des Rates vom 18. Juni 2009 über die Sicherheit von Spielzeug (im Folgenden: "die Richtlinie"). [EU]	On 20 January 2011, the German Federal Government requested the Commission, pursuant to Article 114(4) TFEU, the permission to retain the existing provisions provided in German law for the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances released from toy material, beyond the date of entry into force of Annex II, Part III, to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys [1] (hereinafter 'the Directive').
	Außerdem ist Deutschland der Ansicht, dass Kinder bei allen Kautschukspielzeugen unabhängig von ihrem Verwendungszweck gegenüber Nitrosaminen und nitrosierbaren Stoffen exponiert sind. 	Außerdem stimmt die Kommission überein, dass unter Berücksichtigung des gegenwärtigen Stands der Technik die Entstehung von Nitrosaminen und nitrosierbaren Stoffen bei der Herstellung von Natur- oder Synthesekautschuk durch den Einsatz geeigneter Vulkanisationsbeschleuniger weitgehend vermieden werden kann.
