Ab 2012 bestimmen und veröffentlichen die gemäß Artikel 26 Absatz 1 oder 2 dieser Verordnung bestellten Auktionsplattformen nach Konsultation der Kommission und deren Stellungnahme die Zeitfenster für Gebote, die einzelnen Mengen, die Versteigerungstermine sowie das Auktionsobjekt und die Termine für Zahlung und Lieferung der Zertifikate gemäß Kapitel II der Richtlinie 2003/87/EG, die in einem Kalenderjahr in Einzelversteigerungen versteigert werden sollen, bis zum 28. Februar des Vorjahres oder so bald wie möglich danach. [EU]

As from 2012, the auction platforms appointed pursuant to Article 26(1) or (2) of this Regulation shall determine and publish the bidding windows, individual volumes, auction dates as well as the auctioned product, payment and delivery dates of the allowances covered by Chapter II of Directive 2003/87/EC to be auctioned in individual auctions for each calendar year by 28 February of the previous year, or as soon as practicable thereafter, having previously consulted the Commission and obtained its opinion thereon.

Absatz 3 schließt nicht aus, dass Artikel 36 Absatz 1 auf von einer gemäß Artikel 26 Absatz 2 oder Artikel 30 Absatz 2 bestellten Auktionsplattform durchgeführte Versteigerungen von Zertifikaten in Form von 2-Tage-Spots oder 5-Tage-Futures Anwendung findet, die Finanzinstrumente im Sinne von Artikel 1 Nummer 3 der Richtlinie 2003/6/EG sind, wenn der Mitgliedstaat, in dem die Auktionsplattform niedergelassen ist, Artikel 36 Absatz 1 dieser Verordnung durchgeführt hat oder wenn eine solche Durchführung für die Anwendung von Artikel 36 Absatz 1 nicht notwendig ist. Paragraph 3 shall not preclude Article 36(1) from being applicable with respect to the auctions of allowances in the form of two-day spot or five-day futures that are a financial instrument within the meaning of Article 1(3) of Directive 2003/6/EC conducted by an auction platform appointed pursuant to Article 26(2) or 30(2), where the Member State where the auction platform is established has implemented Article 36(1) of this Regulation or where such implementation is not necessary for the application of Article 36(1) of this Regulation.
