06/04.02.002/2010-10 (Runderlass über Ausfuhrkredite in Rupien/Fremdwährung) der indischen Zentralbank Reserve Bank of India ("Zentralbank") an alle Geschäftsbanken in Indien. [EU] 06/04.02.002/2010-10 (Rupee/Foreign Currency Export Credit) of the Reserve Bank of India ('RBI'), which is addressed to all commercial banks in India.

Am 1. Juli 2011 wurden die Bedingungen für die EC-Regelung mit dem Runderlass "Master Circular on Rupee/Foreign Currency Export Credit & Customer Services to Exporters DBOD No.DIR. (Exp). BC.04/04.02.002/2011-12" geändert. [EU] On 1 July 2011, the terms and conditions of the ECS were revised by Master Circular on Rupee/Foreign Currency Export Credit & Customer Services to Exporters DBOD No DIR. (Exp).

Außerdem bat die Kommission um Aufschluss darüber, ob es nach kommerziellen Grundsätzen verwaltete Policy Loans, wie im Runderlass Nr. 251 erwähnt, gibt. [EU] The Commission also requested clarifications on the existence of policy loans managed commercially, as mentioned in Circular 251.

Den vorliegenden Informationen zufolge finden sich diese Regeln im Runderlass Nr. 251 (2004) der PBOC über Fragen im Zusammenhang mit der Anpassung von Zinssätzen für Einlagen und Kredite –; Yinfa (Circular of PBOC on the Issues about the Adjusting Interest Rates on Deposits and Loans –; Yinfa) ("Runderlass Nr. 251"). Diesbezüglich heißt es im Master Circular über Ausfuhrkredite in Rupien, dass die Höchstzinsen für die in diesem Runderlass vorgesehenen Ausfuhrkredite niedriger sind als die maximalen Kreditzinssätze, die Kreditnehmern normalerweise eingeräumt werden, und in diesem Sinne als eine Vergünstigung zu verstehen sind. [EU] In this respect the Master Circular on Rupee Export Credit notes that 'ceiling rates of interest on credit extended to exporters as prescribed in this Circular are lower than the maximum lending rates normally charged to other borrowers and are, therefore, indicated as concessive in this sense.'

Diesbezüglich sei anzumerken, dass sowohl Kredite in indischen Rupien als auch Kredite in Fremdwährung von demselben Runderlass der indischen Zentralbank erfasst werden, dessen praktische Anwendung unter den Randnummern 60 und 61 beschrieben wird; die ausführlichen und eng gefassten Bestimmungen dieses Runderlasses sind ein Beweis dafür, dass sowohl die Finanzierung der Ausfuhrkredite in Fremdwährung als auch die erhobenen Zinssätze in Verbindung mit eindeutigen Richtlinien stehen, die von der indischen Regierung erlassen wurden. [EU] In this respect it is noted that both Indian rupee and foreign currency export credit form part of the same RBI Master Circular, with the practical implementations described under recitals 60 and 61, whose detailed and restrictive provisions demonstrates that foreign currency export credit funding and interest rates levied are linked to clear government imposed directives.

Die Vorzugszinssätze für die im Rahmen dieser Regelung gewährten und im Runderlass der indischen Zentralbank beschriebenen Kredite (vgl. Randnummer 58) können den Zinsaufwand des begünstigten Ausführers im Vergleich zu den Kosten eines nach marktüblichen Bedingungen gewährten Kredits senken, so dass dem betreffenden Ausführer in diesem Falle ein Vorteil im Sinne des Artikels 2 Absatz 2 der Grundverordnung erwächst.
