Regulation (EC) No 48/2004 of the European Parliament and of the Council of 5 December 2003 on the production of annual Community statistics on the steel industry for the reference years 2003-2009

"Ausgangspunkt für die Identifikation von Trends" bezeichnet den Durchschnittswert, der auf der Grundlage des gemäß Artikel 8 der Richtlinie 2000/60/EG umgesetzten Überwachungsprogramms mindestens in den Referenzjahren 2007 und 2008 gemessen wurde oder der im Falle von nach diesen Referenzjahren ermittelten Stoffen im ersten Zeitraum gemessen wurde, für den ein repräsentativer Zeitraum mit Überwachungsdaten verfügbar ist. 'baseline level' means the average value measured at least during the reference years 2007 and 2008 on the basis of monitoring programmes implemented under Article 8 of Directive 2000/60/EC or, in the case of substances identified after these reference years, during the first period for which a representative period of monitoring data is available.

The Commission notes also that in their letter of 16 January 2004 the Italian authorities gave no justification for the choice of reference years used for calculating the loss and no reply to the question how a loss of production of 20 or 30 % was possible, while the estimates of production for the region showed, for 2002, a production higher than that for the three years used as a reference for the calculation of the losses.

The provisions of Regulation (EC, Euratom) No 58/97 shall continue to apply as regards the collection, compilation and transmission of data for reference years up to and including 2007.
