[EU]	It is evident from the data mentioned in recital 18 that a quantitative change in the pattern of Community imports of the product concerned occurred and that Chinese imports into the Community decreased significantly in 2005, while at the same time there was a surge of exports of the product concerned to the Community from Korea, a country where there is no production of silicon.
	Bei der betroffenen Ware handelt es sich um dieselbe Ware wie bei der Untersuchung, welche die Einführung der geltenden Maßnahmen nach sich zog, und zwar um Silicium-Metall mit Ursprung in China, das dem KN-Code 28046900 (Siliciumgehalt von weniger als 99,99 GHT) zugewiesen. [EU]	The product under consideration is the same as in the investigation which led to the imposition of the existing measures, i.e. silicon metal originating in the PRC, classifiable within CN code 28046900 (silicon content less than 99,99 % by weight).

	Bereits 2006-2007 wurde eine Umgehungsuntersuchung betreffend die Einfuhren von Silicium durchgeführt, die der Verordnung (EG) Nr. 42/2007 des Rates zur Ausweitung des mit der Verordnung (EG) Nr. 398/2004 des Rates eingeführten endgültigen Antidumpingzolls auf die Einfuhren von Silicium-Metall mit Ursprung in der Volksrepublik China auf die Einfuhren von aus der Republik Korea versandtem Silicium-Metall, ob als Ursprungserzeugnis der Republik Korea angemeldet oder nicht, zugrunde lag. [EU]	An anti-circumvention investigation concerning imports of silicon was also carried out in 2006-2007 which led to Council Regulation (EC) No 42/2007 [3] extending the definitive anti-dumping duty imposed by Regulation (EC) No 398/2004 on imports of silicon originating in the People's Republic of China to imports of silicon consigned from the Republic of Korea whether declared as originating in the Republic of Korea or not.
	Da es keine andere hinreichende Begründung oder wirtschaftliche Rechtfertigung im Sinne des Artikels 13 Absatz 1 zweiter Satz der Grundverordnung gibt, wird der Schluss gezogen, dass sich die Veränderung des Handelsgefüges aus dem Antidumpingzoll ergibt, der auf Einfuhren von Silicium-Metall mit Ursprung in der VR China erhoben wird, und vermutlich, wie vom Antragsteller vorgebracht, durch den Versand über Korea verursacht wird. [EU]	It is therefore concluded that, in the absence of any other sufficient due cause or economic justification within the meaning of the second sentence of Article 13(1) of the basic Regulation, the change in the pattern of trade stemmed from the anti-dumping duty imposed on imports of silicon originating in China and must be assumed, as the complainant states, to consist in transhipment through Korea.
	Da kein koreanisches Unternehmen, das Silicium-Metall in die EU ausführte, an dieser Untersuchung mitarbeitete, stützte sich die Feststellung der Umgehung gemäß Artikel 18 der Grundverordnung auf die verfügbaren Fakten, d. h. unter anderem auf die im Antrag enthaltenen Angaben. [EU]	The request alleged that the anti-dumping measures in force on imports of silicon originating in China were being circumvented by means of transhipment via the Republic of Korea (Korea).
	Der Antrag wurde von Euroalliages, dem Verbindungsausschuss der Ferrolegierungsindustrien (nachstehend "Antragsteller" genannt), im Namen der Hersteller eingereicht, auf die ein Großteil, nämlich 100 %, der Gemeinschaftsproduktion von Silicium-Metall entfällt. [EU]	The request was submitted by Euroalliages (Liaison Committee of the Ferro-Alloy Industry) (the applicant) on behalf of producers representing a major proportion, namely 100 %, of the Community production of silicon.
