Auf Grundlage der Auskünfte und Argumente, die Spanien vorlegte, hält es die Kommission für ausreichend bewiesen, dass bei dem Hauptkreditgeschäft zwischen dem ICF und der ICB das Prinzip des Investors in einer Marktwirtschaft erfüllt ist und es sich bei dem nachrangigen Darlehen zwischen der ICB und Chupa Chups um ein Finanzgeschäft zwischen zwei privaten Partnern handelt. On the basis of the information and arguments provided by Spain, the Commission considers that it has been sufficiently proved that the market economy investor principle was complied with in the main credit operation between ICF and ICB, and that the subordinated loan between ICB and Chupa Chups is a financial operation between two private parties.
