Am 2. April 2011 gab die Kommission mit der Bekanntmachung Nr. 2011/C 102/08 die Einleitung einer teilweisen Interimsüberprüfung nach Artikel 19 der AS-Grundverordnung bekannt, die auf die Untersuchung der Subventionierung in Bezug auf den Antragsteller beschränkt war. [EU]

On 2 April 2011, by Notice 2011/C 102/08 [15], the Commission announced the initiation of a partial interim review pursuant to Article 19 of the basic AS Regulation, limited in scope to subsidisation and to the applicant.

Am 3. Januar 2011 ging bei der Europäischen Kommission (Kommission) ein Antrag ein, der die angebliche Subventionierung von bestimmtem Polyethylenterephthalat ("PET") mit Ursprung in Oman und Saudi-Arabien ("betroffene Länder") betraf, was den Wirtschaftszweig der Union schädigen würde. [EU]

On 3 January 2011, the European Commission (Commission) received a complaint concerning the alleged subsidisation of certain polyethylene terephthalate (PET) originating in Oman and Saudi Arabia (the countries concerned), thereby causing injury to the Union Industry.

Angesichts der endgültigen Schlussfolgerungen im Hinblick auf Subventionierung, Schädigung, Schadensursache und Unionsinteresse sollte nach Artikel 15 Absatz 1 der Grundverordnung für Einfuhren der betroffenen Ware mit Ursprung in Iran, Pakistan und den Vereinigten Arabischen Emiraten entsprechend der Regel des niedrigeren Zolls ein endgültiger Ausgleichszoll jeweils in Höhe der Subventions- bzw. der Schadensbeseitigungsspanne eingeführt werden, je nachdem, welche Spanne niedriger ist. In view of the definitive conclusions reached with regard to subsidisation, injury, causation and Union interest, and in accordance with Article 15(1) of the basic Regulation, it is considered that a definitive countervailing duty should be imposed on imports of the product concerned originating in Iran, Pakistan and the United Arab Emirates at the level of the lowest of the subsidisation and injury elimination level found, in accordance with the lesser duty rule.

In the light of the foregoing conclusions reached with regard to subsidisation, injury, causation and Union interests, and in accordance with Article 15(1) of the basic Regulation, it is considered that a definitive countervailing duty should be imposed on imports of the product concerned originating in the PRC at the level of the lower of the subsidy and the injury margins in line with the lesser duty rule.
