MQA fügt hinzu: Werden die Darlehen als Beihilfen betrachtet, die nicht nur zugunsten des transparenten FPAP, sondern zugunsten der angeschlossenen Fischereiunternehmen gewährt werden, handelt es sich tatsächlich um soziale Beihilfen. Die auf diese Weise geleistete finanzielle Unterstützung wäre dann nämlich direkt mit der Entlohnung der Seeleute verknüpft ("Si les emprunts sont considérés comme des aides au profit, non pas du FPAP transparent, mais des entreprises de pêche adhérentes, il s'agirait véritablement d'aides sociales. Le concours financier qui serait ainsi apporté serait en effet directement lié à la rémunération des marins."). [EU]

MQA adds: 'If the loans are regarded as aid, not for the FPAP, which is transparent, but for its member fisheries undertakings, it really would be social assistance, since the financial assistance thus granted would be directly linked to the sailors' pay'.

MQA zufolge könnte es sich auch um sozioökonomische Maßnahmen handeln: "les lignes directrices (...) considèrent que peuvent être déclarées compatibles des mesures socio-économiques. En l'espèce, le FPAP est totalement transparent et les mesures qualifiées d'aides par la Commission ont un caractère à l'évidence socio-économique." (Die Leitlinien (...) besagen, dass sozioökonomische Maßnahmen für mit dem Gemeinsamen Markt vereinbar erklärt werden können. [EU]

According to MQA, the measures in question may also be socioeconomic measures: 'the guidelines (...) state that socioeconomic measures may be declared compatible.

Schließlich sind sowohl Frankreich als auch der FPAP und sein Verwaltungsrat der Auffassung, dass die Kommission das Vorliegen einer staatlichen Beihilfe nicht präjudizieren könne, solange kein Rückzahlungsausfall festgestellt worden sei. (Die entsprechenden Ausführungen lauten: Frankreich: "l'avance remboursable ne peut être qualifiée d'aides d'Etat tant que l'échéance de remboursement n'est pas échue". [EU]

Lastly, France and the FPAP and its Board take the view that the Commission cannot prejudge the existence of State aid as long as no repayment default has been established (France: 'the repayable advance cannot be regarded as State aid as long as the repayment deadline has not fallen'; FPAP: 'Can this amount be repaid or not?
