Das deutsche Branntweinmonopol wurde durch das Gesetz vom 8. April 1922 eingeführt und infolge der Rechtsprechung des Gerichtshofes der Europäischen Gemeinschaften u.a. das Urteil vom 17. Februar 1976 in der Rechtssache 45/75( Rewe-Zentrale) [7] - - durch das Gesetz vom 2. Mai 1976 [8] geändert. [EU]

The German spirits monopoly was introduced by the Law of 8 April 1922 [6] and amended as a consequence of decisions of the Court of Justice of the European Communities (inter alia Case 45/75 Rewe-Zentrale [7] by the Law of 2 May 1976 [8].

Das neue Gesetz vom 2. Mai 1976 über das Branntweinmonopol hat die aus den territorialen Schutzmaßnahmen resultierende Preisstützungspolitik, die im Widerspruch zu Artikel 31 EG-Vertrag (ex-Artikel 37) stand, abgeschafft, um sie durch einen Preisausgleichsmechanismus zu ersetzen. [EU]

The new Law of 2 May 1976 on the Spirits Monopoly abolished the price support policy resulting from the territorial protective measures, which infringed Article 31 EC (ex Article 37), and replaced them with a price compensation mechanism.
