	Weiter ist Arntzen der Ansicht, dass es am 1. Januar 2003 eigentlich keinen Marktpreis gab, da alle Betriebs- und Instandhaltungsdienstleistungen intern ausgeführt wurden und mit der Gründung der Mesta AS am 1. Januar 2003 de facto ein Monopol geschaffen wurde. [EU]	Arntzen further submits that, in fact, there was no market price on 1 January 2003 since all operation and maintenance services were carried out in-house and a de facto monopoly was created on 1 January 2003 with the establishment of Mesta AS.
	Wenn die Überwachungsbehörde zu dem Ergebnis komme, dass die Umstrukturierungsmaßnahmen doch als staatliche Beihilfe zu betrachten seien, ist Arntzen der Ansicht, dass die Beihilfe zulässig wäre, da sie die Mesta AS in die Lage versetze, sich mit gleichen Chancen am Wettbewerb in einem Markt zu beteiligen, der erst vor kurzem für den Wettbewerb geöffnet wurde.
