	Der Rechnungsführer veranlasst die Eingabe einer W4-Warnmeldung zu Dritten, die von der Kommission Einziehungsanordnungen über signifikante Beträge erhalten haben und mit ihren diesbezüglichen Zahlungen deutlich in Verzug sind. [EU]	The accounting officer shall enter a W4 warning in relation to third parties who are the subject of recovery orders issued by the Commission exceeding a certain amount and on which payment is significantly overdue.
	Eine W4-Warnmeldung bleibt solange gespeichert, bis der geschuldete Betrag bezahlt wird. [EU]	Any W4 warning shall remain active as long as the debt is outstanding.
	Ist eine W2-, W3b- oder W4-Warnmeldung zu dem Zeitpunkt registriert, zu dem der verantwortliche BAB oder seine Mitarbeiter das FWS gemäß Artikel 6 Absatz 2 Buchstabe a konsultieren, dann unterrichtet der BAB - sofern es in diesem Verfahrensstadium zulässig ist - den für die Vergabe des Auftrags oder der Finanzhilfe zuständigen Bewertungsausschuss vom Vorliegen der Warnmeldung, falls diese Warnmeldung ein neues Element darstellt, das in Verbindung mit den Auswahlkriterien für diesen Auftrag oder diese Finanzhilfe geprüft werden muss. [EU]	Where a W2, W3b or W4 warning is registered at the time the AOD responsible or his staff consults the EWS in accordance with point (a) of Article 6(2), he shall inform, if the stage of the procedure so permits, the evaluation committee for the award of contract or grant concerned of the existence of such warning in so far as the existence of such warning constitutes a new element to be examined in connection with the selection criteria for that contract or grant.
	Sofern die Gründe für die nicht erfolgte Registrierung einer W2-, W3b- oder W4-Warnmeldung in Verbindung mit dem laufenden Auftrag bzw. der laufenden Finanzhilfe oder dem damit verbundenen Vergabeverfahren stehen, trifft der verantwortliche BAB unter Berücksichtigung der Art der Warnmeldung sowie ihrer voraussichtlichen Auswirkungen auf die weitere Abwicklung des laufenden Auftrags bzw. der laufenden Finanzhilfe nach Abwägung der jeweiligen Risiken, einschließlich des Risikos eines Gerichtsverfahrens, folgende Maßnahmen: [EU]	Where a W2, W3b or W4 warning has not been registered for reasons related to the ongoing contract or grant or to the relevant award procedure, the AOD responsible may, depending on the type of warning and the consequences, which it is likely to have on the performance of the ongoing contract or grant, and after giving due consideration to the risks involved, including that of judicial litigation, take the following actions:
	Sofern die Gründe für eine W2-, W3b- oder W4-Warnmeldung in Verbindung mit der Abwicklung oder Vergabe eines laufenden Auftrags bzw. einer laufenden Finanzhilfe oder mit dem damit verbundenen Vergabeverfahren stehen, trifft der verantwortliche BAB unter Berücksichtigung der Art und Begründung der Warnmeldung sowie ihrer voraussichtlichen Auswirkungen auf die weitere Abwicklung des Auftrags bzw. der Finanzhilfe, insbesondere was Betrag, Dauer und gegebenenfalls Dringlichkeit der Abwicklung angeht, nach Abwägung der jeweiligen Risiken eine oder mehrere der folgenden Maßnahmen: [EU]	Where a W2, W3b or W4 warning has been registered for reasons related to the performance or award of an ongoing contract or grant or to the relevant award procedure, the AOD responsible may, after giving due consideration to the risks involved, to the nature of the warning and its justification, to the consequences which it is likely to have on the performance of the contract or grant, especially with regard to the amount, duration and, where applicable, the urgency of the latter, take one or more of the following actions:
	Sollte der Dritte, für den im FWS eine W2-, W3b- oder W4-Warnmeldung vorliegt, auf der Liste des Bewertungsausschusses oben stehen, trifft der verantwortliche BAB angesichts seiner Verpflichtung zum Schutz des Ansehens und der finanziellen Interessen der Gemeinschaften und unter Berücksichtigung der Art und Schwere des die Warnmeldung begründenden Tatbestands, des Betrags und der Dauer des Auftrags bzw. der Finanzhilfe sowie gegebenenfalls der Dringlichkeit der Abwicklung eine der folgenden Entscheidungen: [EU]	If the third party for which a W2, W3b or W4 warning has been registered heads the list of the evaluation committee, the AOD responsible, having due regard to the obligation to protect the Community's financial interests and image, the nature and seriousness of the justification for the warning, the amount and duration of the contract or grant and, where applicable, the urgency with which it has to be implemented, shall take one of the following decisions:
	Wird in das FWS eine W4-Warnmeldung gegen einen Dritten eingegeben, so prüft der Rechnungsführer systematisch, ob eine Aufrechnung der Forderungen der Gemeinschaften mit etwaigen diesem Dritten noch geschuldeten Beträgen gemäß Artikel 73 der Haushaltsordnung und Artikel 83 der Verordnung (EG, Euratom) Nr. 2342/2002 möglich ist. [EU]	Where a third party is subject to a W4 warning, the accounting officer shall systematically examine the possibility of offsetting Community entitlements with payment due to that third party in compliance with Article 73 of the Financial Regulation and Article 83 of Regulation (EC, Euratom) No 2342/2002.
