	Am 18. 	Die in Artikel 1 genannte Beihilfe darf nicht gewährt werden, bevor Italien gegenüber der Kommission nachgewiesen hat, dass AEM Torino entweder keine Beihilfe im Rahmen der mit Entscheidung 2003/193/EG für rechtswidrig und mit dem Gemeinsamen Markt unvereinbar erklärten Regelung zugunsten der "aziende municipalizzate" erhalten oder die frühere Beihilfe im Rahmen der genannten Regelung einschließlich der Zinsen zurückgezahlt hat. [EU]	The aid referred to in article 1 may not be granted before Italy has submitted evidence to the Commission that AEM Torino either has not benefited from previous aid granted under the 'municipalizzate' scheme declared illegal and incompatible by the Decision 2003/193/EC or that it has reimbursed with interests the previous aid received under the above-mentioned scheme.

Juni 2002 über staatliche Beihilfen in Form von durch Italien gewährte Steuerbefreiungen und Vorzugsdarlehen für Unternehmen der Daseinsvorsorge mit öffentlicher Mehrheitsbeteiligung sind. [EU]	It appeared that the intended recipient, ACEA S.p.A., is one of the former 'aziende municipalizzate' (public utilities owned by local public administrative bodies) in the energy sector which has benefited of the aid schemes assessed in the Commission Decision 2003/193/EC of 5 June 2002 on State aid granted by Italy in the form of tax exemptions and subsidised loans to public utilities with a majority public capital holding [5] (State aid C 27/99, ex NN 69/98).
	Unter Berücksichtigung des im vorgenannten Urteil niedergelegten Grundsatzes stellt die Kommission im vorliegenden Fall Folgendes fest: a) AEM Torino hat eine frühere Beihilfe erhalten, nämlich die Beihilfe für "aziende municipalizzate" (siehe Erwägungsgründe 9 - 15), die gemäß der Entscheidung 2003/193/EG zurückzufordern ist; b) die italienischen Behörden sind bisher noch nicht ihrer Verpflichtung zur Rückforderung aufgrund der vorgenannten Entscheidung nachgekommen. [EU]	By applying the principle stated in the above judgement to the present case, the Commission realizes that: a) AEM Torino has benefited from a previous aid, notably the aid granted to the municipalizzate (see paragraphs 9 to 15 above), that has to be recovered pursuant to the Decision 2003/193/EC; and b) the Italian authorities have not complied yet with the recovery obligation contained in the Decision 2003/193/EC.
