Bei dem Beschwerdeführer handelt es sich um ein österreichisch-ukrainisches Konsortium, dem zum Zeitpunkt des Verkaufs der BB die beiden ukrainischen Joint Stock Companies "Ukrpodshipnik" und "Ilyich" und die beiden österreichischen Gesellschaften SLAV AG und SLAV Finanzbeteiligung GmbH angehörten, wobei Letztere speziell für die Zwecke des Erwerbs der BB gegründet worden war. The complainant is an Austro-Ukrainian consortium which, at the time of the sale of BB, consisted of two Ukrainian joint-stock companies, Ukrpodshipnik and Ilyich, and two Austrian companies, SLAV AG and SLAV Finanzbeteiligung GmbH, the latter one having been founded specifically for the purpose of acquiring BB.

Bezüglich der Erwägungen des Landes Burgenland zum möglichen Ausgang des FMA-Verfahrens kann die Kommission dem Vorbringen Österreichs ebenfalls nicht folgen, dass ein 1994 von einem Vorgänger der SLAV AG gestellter Antrag auf Erteilung einer Bankkonzession abgelehnt wurde. [EU]

Referring to the Province of Burgenland's own considerations in order to second-guess the FMA's decision, the Commission also cannot accept Austria's reference to an earlier application for a banking licence made by a predecessor of SLAV AG in 1994.
