	Auf Grund der bestehenden Zweifel hinsichtlich der Vereinbarkeit dieser Vergütung mit dem Grundsatz des marktwirtschaftlich handelnden Kapitalgebers hat die Kommission im Juli 2002 das Verfahren C 48/2002 eröffnet. 	Aus diesem Grund hat die Kommission darauf bestanden, dass nach dem Vertrag zwischen dem Land Berlin und der Bank vom 26. Dezember 2002 über die Behandlung möglicher Rückzahlungsansprüche des Landes aus einer Kommissionsentscheidung über das Beihilfeverfahren C 48/02 nur insoweit der mögliche Rückforderungsbetrag in der Bank in Form einer Einlage belassen wird, als dies notwendig ist, um eine Kernkapitalquote von 6,0 % (bzw. eine Gesamtkapitalquote von 9,7 %, die bereits in der Entscheidung über die Rettungsbeihilfe anerkannt wurde) auf Basis des Jahresabschlusses 2002 zu erreichen. 	Sollte die Kommission in ihrer Entscheidung über das Verfahren C 48/2002 dem Land Berlin einen Anspruch gegen die Bank auf Rückzahlung von einem mit dem Gemeinsamen Markt unvereinbaren Beihilfeelement auferlegen, belässt das Land Berlin diesen als Einlage in der Bank.
