On 20 January 2011, the German Federal Government requested the Commission, pursuant to Article 114(4) TFEU, the permission to retain the existing provisions provided in German law for the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances released from toy material, beyond the date of entry into force of Annex II, Part III, to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys [1] (hereinafter 'the Directive').

Januar 2011 stellte die Regierung der Bundesrepublik Deutschland bei der Kommission einen Antrag nach Artikel 114 Absatz 4 des Vertrags über die Arbeitsweise der Europäischen Union (AEUV) auf Genehmigung der Beibehaltung der deutschen Rechtsvorschriften für die fünf Elemente Blei, Arsen, Quecksilber, Barium und Antimon sowie für Nitrosamine und nitrosierbare Stoffe aus Spielzeugmaterialien über den Anwendungsbeginn der Bestimmungen von Anhang II Teil III der Richtlinie 2009/48/EG des Europäischen Parlaments und des Rates vom 18. Juni 2009 über die Sicherheit von Spielzeug hinaus. [EU]

On 20 January 2011, the German Federal Government requested the Commission, pursuant to Article 114(4) of the Treaty on the Functioning of the European Union (TFEU), the permission to retain the existing provisions provided in German law for the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances released from toy material, beyond the date of entry into force of Annex II, Part III of Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys [1].

Angesichts der vorstehenden Ausführungen gelangt die Kommission zu der Schlussfolgerung, dass der ihr am 2. März 2011 vollständig notifizierte Antrag Deutschlands auf Genehmigung der Beibehaltung der Grenzwerte für Blei, Arsen, Quecksilber, Barium und Antimon sowie für Nitrosamine und nitrosierbare Stoffe in Spielzeug für Kinder unter 36 Monaten oder in Spielzeug, das bestimmungsgemäß in den Mund genommen wird, zulässig ist. [EU]

In the light of the foregoing, the Commission concludes that the application of Germany, completely notified to it on 2 March 2011, with a view of obtaining approval for maintaining the values for lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances, for use in toys intended for use by children under 36 months or in other toys intended to be placed in the mouth, is admissible.

Angesichts der vorstehenden Ausführungen ist die Kommission der Auffassung, dass der Antrag Deutschlands auf Genehmigung der Beibehaltung seiner für die fünf Elemente Blei, Arsen, Quecksilber, Barium und Antimon sowie für Nitrosamine und nitrosierbare Stoffe geltenden einzelstaatlichen Bestimmungen zulässig ist. [EU]

In the light of the foregoing, the Commission considers that the application submitted by Germany with a view to obtaining authorisation to maintain its national provisions on the five elements: lead, arsenic, mercury, barium and antimony, as well as for nitrosamines and nitrosatable substances, is admissible.

Angesichts dieser Überlegungen kommt die Kommission zu der Schlussfolgerung, dass die von Deutschland mitgeteilten einzelstaatlichen Maßnahmen in Bezug auf Quecksilber, Arsen und Antimon nicht durch wichtige Erfordernisse in Bezug auf den Schutz der menschlichen Gesundheit gerechtfertigt sind. [EU]

In the light of the above considerations, the Commission concludes that the national provisions notified by Germany with regard to mercury, arsenic and antimony are not justified on grounds of major need of protection of human health.

Angesichts dieser Überlegungen vertritt die Kommission die Auffassung, dass die von Deutschland mitgeteilten Maßnahmen in Bezug auf Antimon nicht als durch wichtige Erfordernisse in Bezug auf den Schutz der menschlichen Gesundheit gerechtfertigt anzusehen sind. [EU]

In the light of the above considerations, the Commission is of the opinion that the measures notified by Germany with regard to antimony can not be considered as justified on grounds of major need of protection of human health.

Anhang II Teil III Nummer 13 der Richtlinie enthält genaue Migrationsgrenzwerte für verschiedene Elemente, u. a. Blei, Arsen, Quecksilber, Barium und Antimon. [EU]
