[EU]	This Regulation should not affect other rights of passengers established by Community legislation and notably Council Directive 90/314/EEC of 13 June 1990 on package travel, package holidays and package tours and Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to air passengers in the event of denied boarding and of cancellation or long delay of flights.
	Die Verordnung (EG) Nr. 261/2004 des Europäischen Parlaments und des Rates vom 11. Februar 2004 über eine gemeinsame Regelung für Ausgleichs und Unterstützungsleistungen für Fluggäste im Fall der Nichtbeförderung und bei Annullierung oder großer Verspätung von Flügen und zur Aufhebung der Verordnung (EWG) Nr. 295/91 ist in das Abkommen aufzunehmen. [EU]	Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91 is to be incorporated into the Agreement.
	Einem behinderten Menschen oder einer Person mit eingeschränkter Mobilität, der die Anbordnahme aufgrund ihrer Behinderung oder eingeschränkten Mobilität verweigert wurde, sowie jeder diese Person gemäß Absatz 2 des vorliegenden Artikels begleitenden Person muss der Anspruch auf Erstattung oder anderweitige Beförderung gemäß Artikel 8 der Verordnung (EG) Nr. 261/2004 angeboten werden. [EU]	A disabled person or a person with reduced mobility who has been denied embarkation on the grounds of his or her disability or reduced mobility and any person accompanying this person pursuant to paragraph 2 of this Article shall be offered the right to reimbursement or re-routing as provided for in Article 8 of Regulation (EC) No 261/2004.

L 46 vom 17.2.2004, S. 1) ist das betreffende Land der Mitgliedstaat, der für Zwischenfälle im Zusammenhang mit allen Flügen von Flughäfen in seinem Gebiet und für Flüge von Luftfahrtunternehmen der EU zu diesen Flughäfen zuständig ist. [EU]	In the case of air transport, pursuant to Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights (OJ L 46, 17.2.2004, p. 1), the relevant country is the Member State competent for incidents related to all flights from airports situated on its territory, and for Union air carriers' flights from third countries to such airports.
	In Anhang XIII des Abkommens wird nach Nummer 68ab (Verordnung (EG) Nr. 261/2004 des Europäischen Parlaments und des Rates) folgende Nummer eingefügt: [EU]	The following point shall be inserted after point 68ab (Regulation (EC) No 261/2004 of the European Parliament and of the Council) of Annex XIII to the Agreement:

[EU]	In addition to the situations covered by Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights [8], passengers should be offered the right to reimbursement or to re-routing in certain specific other situations falling within the scope of this Regulation, if there is a sufficiently close connection with the Community.
