	(32) Artikel 18 des Dekrets 2005-1635 vom 26. Dezember 2005 sieht vor, dass die CRP-RATP die Möglichkeit hat, einen Teil der Rentenansprüche des Sondersystems für die RATP-Beschäftigten finanziell an die Systeme nach allgemeinem Rentenrecht (CNAV und ARGIC [18]/ARRCO [19]) anzulehnen [20], d. h. die Rentenvorgänge der CRP-RATP technisch auf die allgemeinem Rentensysteme (nachstehend "Aufnahmesysteme" genannt) zu übertragen. [EU]	Article 18 of Decree 2005-1635 of 26 December 2005, as referred to above, makes it possible for the CRP-RATP to financially affiliate some of the RATP special pension scheme entitlements to statutory schemes (CNAV [17] and ARGIC [18]/ARCCO [19]) [20], i.e. a technical transfer of CRP-RATP pension transactions to statutory schemes (receiving schemes) is possible.
	Angesichts dieser Rechtsprechung sind nach Auffassung der Kommission aus den folgenden Gründen weder die CRP-RATP noch die Rentenkassen, die die aktiv Beschäftigten und Rentenempfänger der RATP aufnehmen, d. h. CNAV und AGIRC-ARRCO, Unternehmen im Sinne des gemeinschaftlichen Wettbewerbsrechts. [EU]	In the light of this case law, the Commission considers that neither the CRP-RATP nor the pension funds serving current and retired RATP employees, i.e. CNAV and AGIRC-ARRCO, are undertakings within the meaning of Community competition law for the following reasons.

	Die derzeit bei der CNAV geltende Methode ist der Vergleich des Verhältnisses zwischen dem aktuellen wahrscheinlichen Wert der bereits erworbenen Ansprüche und den Beitragsgrenzen für ein Jahr zum Bewertungstag, angepasst durch das Durchschnittsalter der Beitragszahler des integrierten Systems und des Aufnahmesystems. [EU]	The methodology currently used by the CNAV scheme involves comparing, at the evaluation date, the ratio between the likely present value of the rights already acquired and the contributive capacity over a year, modulated by the average age of the contributors, for the transferor scheme and the transferee scheme.
	Was die Basisansprüche betrifft, so sieht die Reform die Anlehnung des Sondersystems der IEG an das allgemeine System (die Caisse Nationale d'Assurance Vieillesse des Travailleurs Salariés - CNAV) und an die zusätzlichen obligatorischen Systeme (Association Générale des Institutions de Retraite des Cadres - AGIRC und Association des Régimes de Retraite Complémentaires - ARRCO) vor.
