Am 13. März 2001 wurde zwischen der SYMBIO einerseits und der Gesellschaft "S.M.V.P - Mise en Valeur du Patrimoine Culturel", Tochterunternehmen der Gesellschaft Parc Astérix, die Übertragung öffentlicher Aufgaben unterzeichnet, deren Gegenstand eine "Konzession für die Gestaltung, Realisierung und den Betrieb des Themenparks Bioscope" ist. This was confirmed on 13 March 2001 with the signing of a public-service delegation contract for 'the design, construction and management of the Bioscope theme park' between Symbio, on the one hand, and SMVP, a subsidiary of Parc Astérix, on the other.

The measure which France has implemented for 'SMVP - Mise en valeur du patrimoine culturel' and the conditions of which are laid down in the public-service delegation contract granting the concession for 'the design, construction and operation of the Bioscope theme park' between, on the one hand, Symbio and, on the other, 'SMVP - Mise en valeur du patrimoine culturel', as modified by the amendment dated 9 July 2002, while constituting State aid, is compatible with the common market within the meaning of Article 87(3)(c) of the EC Treaty.
