	Am 13. Oktober 2003 reichte die CFF beim Gericht erster Instanz der Europäischen Gemeinschaft (nachstehend "das Gericht" genannt) Klage auf Nichtigerklärung der Entscheidung von 2003 ein (Rechtssache T-349/03). [EU]	Concerning the compatibility of the EUR 53,48 million paid as compensation for public service costs in accordance with Article 86(2) EC, the French authorities note that, first, in its 2003 decision, the Commission had already declared that amount as compatible with that article and, secondly, the CFI did not call it into question in its judgment in Case T-349/03.
	In seinem Urteil vom 15. Juni 2005 zur Nichtigerklärung der Entscheidung der Kommission von 2003 forderte das Gemeinschaftsgericht die Kommission auf, den Betrag von 53,48 Mio. EUR im Lichte des Urteils des Gerichtshofs vom 24. Juli 2003 in der Rechtssache Altmark zu prüfen.
