By judgment of 5 October 2004, confirming a judgment of the Paris Administrative Court of 26 April 2001, the Paris Administrative Court of Appeal ordered the French State to recover the aid paid to CELF.

According to the Council of State, the Administrative Court of Appeal was able to legally ground its ruling on the fact that it was not established that the amount of aid did not exceed the costs resulting from the public service obligations imposed on CELF, and on the fact that no prior and transparent definition of the basis of the compensation had been given.
