Darin wird im Einklang mit § 52 a Abs. 1 Rundfunkstaatsvertrag und § 6 a Abs. 1 Medienstaatsvertrag insbesondere geregelt, dass bei der erstmaligen Zuweisung digitaler terrestrischer Übertragungskapazitäten diejenigen Programme vorrangig zu berücksichtigen sind, die in Berlin und Brandenburg bereits analog verbreitet werden. The legal basis for this assistance is Section 40(1)(2) of the State Broadcasting Treaty (Rundfunkstaatsvertrag) and Section 88(3) of the Media Law of North Rhine-Westphalia, pursuant to which the Land media authorities and, in the present case, LfM are charged with promoting, among other things, the development of the technical infrastructure for broadcasting and projects for new broadcasting technologies out of their share of the licence fee (Rundfunkgebühr).
