Polen übermittelt der Kommission den ausführlichen Abschlussbericht mit Angaben zu den ausgezahlten Beihilfebeträgen sowie zur Ausführung der Beihilfevereinbarung und zu allen anderen Investitionsvorhaben in derselben Produktionsstätte innerhalb einer Frist von sechs Monaten ab Auszahlung der letzten Tranche entsprechend dem angemeldeten Zahlungsplan. The Polish authorities shall submit to the Commission a detailed final report including information on the aid amounts paid, on the execution of the aid contract and on any other investment projects started at the same establishment or plant, within 6 months of payment of the last tranche of the aid according to the notified payment schedule.

Wenn die Kommission seinerzeit Zweifel an der Plausibilität der im Zahlungsplan prognostizierten Verluste gehabt hätte, hätte sie die Beihilfe nicht als Pauschalsumme genehmigen dürfen, sondern eine Klausel einbauen müssen, die besagt, dass die Genehmigung nur für Beihilfen bis zur Höhe der tatsächlichen Verluste gilt. In case the Commission doubted the plausibility of the loss prognosis in the business plan at the time, it should not have approved the aid as a lump sum but should have inserted a provision in its approval stating that the approval only covered aid that corresponded to the actual losses.

Zur Deckung dieser Summe seien nicht nur, wie in dem der Kommission übermittelten Zahlungsplan ausgewiesen, die Bar-Beihilfe in Höhe von 29,812 EUR [58,309 Mio. DEM] aufgewendet worden, sondern auch Eigenmittel der Werft, die als Positionen in der Bilanz aufgeführt worden seien. [EU]

To cover this amount, there was not only the amount of EUR 29,812 million (DEM 58,309 million) operating aid paid in cash, as indicated in the paying schedule (Zahlungsplan) submitted to the Commission, but also own resources of the yard which appeared as positions in the balance sheet.
